Detailed rules for the implementation of the registration of overseas suppliers of imported waste raw materials

Chapter I General Provisions

Article 1 is to effectively strengthen the registration management of overseas suppliers of imported waste raw materials and standardize the registration management of overseas suppliers applying for registration, The detailed rules are formulated in accordance with the Announcement No. 115 of the General Administration of quality supervision, inspection and Quarantine of the people's Republic of China (hereinafter referred to as the General Administration of quality supervision, inspection and Quarantine of the people's Republic of China) in 2003 and the mandatory requirements of China's national technical specifications such as environmental protection and control standards for imported waste raw materials

Article 2 These rules are applicable to the registration management of overseas supply enterprises (hereinafter referred to as overseas enterprises, referring to the seller of the contract) applying for the import of waste raw materials (except waste ships)

Article 3 the General Administration of quality supervision, inspection and Quarantine of the people's Republic of China shall uniformly manage the registration and administration of overseas enterprises

Article 4 any overseas enterprise that exports waste raw materials to China must apply for registration with the AQSIQ

waste raw materials of overseas enterprises that have not been registered are not allowed to be imported, and the port inspection and quarantine authority will not accept their inspection applications

Chapter II registration conditions and application

Article 5 an overseas enterprise applying for registration must meet the following conditions:

first, it is a legal business enterprise in the country (region) where it is located

second, there is a fixed office or processing place with a certain business scale

III. be familiar with and master China's environmental protection technical regulations and relevant environmental protection control standards, and have the corresponding infrastructure and inspection ability

IV. a quality assurance or environmental quality management system (with ISO14000 certificate) should be established or corresponding certification qualification certificates or corresponding systems should be provided, documented and implemented

v. have a relatively stable supply source, and take weight loading situation quality control measures for the zigzag loading of environmental friendly cantilever zigzag Charpy samples

VI. no major safety, health and environmental protection quality problems have been found in recent 3 years

Article 6 when applying for registration with the AQSIQ, in addition to submitting the materials required by the AQSIQ announcement No. 2003 [115], overseas enterprises should also provide the following written materials:

I. organizational structure, department and post responsibilities

II. Compliance with China's environmental protection technical regulations, relevant environmental protection control standards and China's relevant regulations commitment letter

III. data (plan) of fixed office and processing places

IV Relevant certificates of supply type, quantity and environmental protection quality

v. quality control management system and relevant technicians (including hazardous waste, entrained waste control and waste disposal)

VI. raw material acceptance system

VII. Measurement and equipment calibration system

VIII. Provisions on nonconforming product control

IX. staff training plan

X Commitment to the environmental protection and quality control of goods (commitment to the environmental protection and quality control of the source of supply and the supplier)

Xi. Commitment to bear the relevant costs for the disposal of environmental protection nonconformities of goods

the written materials related to the application for registration submitted to the AQSIQ must be in Chinese or both Chinese and English

Article 7 the application for registration shall not be accepted under any of the following circumstances:

first, the materials provided do not meet the requirements of Articles 5 and 6

II. Tighten when mentioned; The materials provided are untrue or falsified

III. the waste raw materials exported to China in the past three years do not meet the requirements of environmental protection control standards, and are found to be suppliers

IV. export waste raw materials are fraudulently loaded with dangerous or prohibited goods, or there are fraudulent acts, which are found to be suppliers

v. it needs to be returned due to unqualified environmental protection inspection, and the serious impact is caused by not actively returning

VI. discarding unqualified goods has a serious impact

VII. Re import the returned unqualified goods by changing ports

VIII. Forging the pre shipment inspection certificate

IX. the export scale is too small to ensure the quality of arrival

X. others do not meet the requirements of the implementation rules

Chapter III Registration Review and approval

Article 8 the AQSIQ shall make a decision on whether to accept or not within 30 days from the date of receiving the written materials of the registration application:

(I) if it meets the requirements after examination, issue the notice of acceptance of the registration application of overseas suppliers of imported waste raw materials

(2) if it fails to meet the requirements after examination, the applicant shall be notified to make corrections within 30 days. If it fails to make corrections within the time limit, the application shall be deemed to be withdrawn

(III) if it does not comply with the Announcement No. 115 of the General Administration of quality supervision, inspection and Quarantine of the people's Republic of China and the provisions of the review, the application will not be accepted and the applicant will be notified

Article 9 after the AQSIQ issues the notice of acceptance of registration application of overseas suppliers of imported waste raw materials, it organizes reviewers to assess the overseas enterprises applying for registration. The assessment is divided into document review and on-site assessment to verify the integrity and authenticity of the application materials of overseas enterprises, verify the effectiveness of their internal management and quality control measures, and measure and evaluate their ability to ensure that the output products meet the requirements of China's environmental protection control standards

Article 10 organization and implementation of on-site assessment

I. form a review group:

the review group is composed of several experts engaged in the inspection and management of imported waste raw materials and environmental protection control. Its qualification is recognized by the General Administration of quality supervision, inspection and Quarantine of the people's Republic of China, and the review team leader is designated by the General Administration of quality supervision, inspection and Quarantine of the people's Republic of China

II. Document review:

1. The members of the review team shall review the materials submitted by overseas enterprises in accordance with the provisions of Article 6 of these rules, and make a judgment item by item in the column of "document review" according to the requirements of the registration and review record of overseas suppliers of imported waste raw materials (Annex I)

2. After the review of documents, the review team shall make a conclusion of document review and give consent to those that meet the requirements. If it does not meet the requirements, the enterprise shall be notified to correct it within 30 days

3. If the nonconformities found in the document audit are corrected within the time limit, the review team will put forward the agreed opinions after the follow-up audit. If the nonconformities found in the document review fail to be corrected within the time limit, the overseas enterprise shall be deemed to have automatically withdrawn its application

III. on site assessment:

1. The evaluation team should formulate an on-site assessment plan according to the characteristics of the enterprise and the types of waste raw materials it outputs, and notify the assessed overseas enterprises of the on-site assessment plan in writing

2. Implementation of on-site assessment

(1) the review team leader shall hold a meeting to introduce the scope, purpose, basis, plan, method and procedure of the assessment, as well as the resources and facilities required by the review team, the relationship between the review team and the assessed party, confidentiality commitments and other matters to the managers of the assessed party

(2) on site verification. According to the assessment plan, the review team will go to the agreed departments and production and processing sites for on-site verification by sampling method, and collect objective review evidence. In the process of verification, the review team shall check the required items in the column of "on-site review record" item by item, make records and make judgments according to the requirements of the "registration review record of overseas suppliers of imported waste raw materials". If there are non conformances found in the process of on-site verification, a non conformance report shall be formed

(3) review group meeting. According to the needs of the assessment process, the review team held an internal meeting to discuss: ① the progress of the review; ② Form an agreement on the audit findings (and their evidence), and discuss the non conformance report submitted by the assessors; ③ Evaluate the internal management and quality control of the assessed party; ④ Other problems to be solved in the assessment; ⑤ Form assessment opinions

during the assessment process, the review team leader should strengthen the communication and exchange with the managers of the assessed party, and the non conformance report issued should be signed and confirmed by the representative of the assessed party. In addition, both parties shall agree on the time and method of correction and tracking verification of nonconformities

(4) the review team leader presides over a summary meeting, introduces the evaluation findings to the managers and relevant personnel of the assessed party, announces the evaluation opinions and the time and method of tracking and verification

3. The evaluation team leader shall organize the preparation of the evaluation report and submit it to the AQSIQ after the on-site evaluation

Article 11 the General Administration of quality supervision, inspection and Quarantine of the people's Republic of China shall review the review report submitted by the review team. If the review meets the specified conditions, the General Administration of quality supervision, inspection and Quarantine of the people's Republic of China shall register it, issue the registration certificate of overseas supplier of imported waste raw materials, and grant a number

those who fail to pass the audit will be issued a "Notice of non conformity" (Annex 2), and they can apply again 6 months from the date of issuance of the "Notice of non conformity"

Chapter IV follow up management

Article 12 the registration certificate is valid for 3 years. If renewal is required at the expiration of the period, the applicant shall submit an application for renewal to the AQSIQ 3 months before the expiration of the period of validity

if the registered items (legal person and address) of overseas enterprises are changed, they should go through the change procedures with the AQSIQ within 3 months

Article 13 in case of any of the following circumstances of a registered overseas enterprise, the AQSIQ may make a decision to suspend the acceptance of the inspection application until it is disqualified from registration. Enterprises disqualified by the AQSIQ will not accept their applications within three years

(1) violating the relevant laws, regulations and provisions of China's import of waste raw materials in the process of the experiment

(2) violating the relevant provisions of Article 7 of these rules

(3) the port inspection and quarantine institution found that the safety, health and environmental protection were unqualified once during the inspection, and caused serious consequences, which was found to be an overseas enterprise

(4) altering or forging relevant documents and other fraud

(V) failing to report to the General Administration of quality supervision, inspection and Quarantine on time after major changes in the enterprise registration project

(6) transferring the registration certificate or number to other enterprises for use

(7) violating other provisions

Article 14 The AQSIQ or its authorized institution is responsible for the daily supervision and management of overseas enterprises after obtaining certificates, and the authorized institution shall submit the supervision and management to the AQSIQ

the contents of daily supervision and management include:

first, conduct regular or irregular spot checks on the export goods of registered enterprises

II. Check whether the registered enterprises violate the provisions of these measures

III. timely feed back the inspection of goods by the port inspection and quarantine institution to the registered enterprise

IV. timely put forward suggestions to the AQSIQ on suspension or cancellation of registration qualification for the verified violation of Article 13 by the registered enterprise

v. supervise registered enterprises to return unqualified goods

Chapter V supplementary provisions

Article 15 the registration management of imported waste raw material suppliers in Hong Kong, Macao and Taiwan can be implemented with reference to these rules

Article 16 the detailed rules shall be interpreted by the General Administration of quality supervision, inspection and Quarantine of the people's Republic of China

Article 17 these Rules shall come into force as of the date of promulgation
